TERMS AND CONDITIONS OF USE

These terms and conditions of sale are entered into :

on the one hand,

By the company: Jerycan PT whose registered office is located at : R. De novas de Cima, N°159-B, 4810-107 GUIMARAES (PORTUGAL). hereinafter referred to as "THCP": "THCP.FRi" and the operation of the website www.THCP.FR

and, on the other hand

any individual or legal entity wishing to make a purchase via the website https://www.thcp.fr/gb/, hereinafter referred to as "the buyer".

Article 1. PURPOSE

The purpose of these conditions of sale is to define the contractual relationship between Jerycan PT and the buyer, as well as the conditions applicable to any purchase made through the website https://www.thcp.fr/gb/.. The purchase of a product through this website implies the buyer's unreserved acceptance of these conditions of sale, which the buyer acknowledges having read prior to ordering. Prior to any transaction, the buyer declares, on the one hand, that the purchase of products on the https://www.thcp.fr/gb/ site is not directly related to his/her professional activity and is limited to strictly personal use, and on the other hand, that he/she has full legal capacity to enter into a commitment under these general conditions of sale.

Jerycan PT reserves the right to modify these terms and conditions of sale at any time, in order to comply with new regulations or to improve the use of its site. In this case, the applicable conditions will be those in effect on the date of the buyer's order.

Article 2. THE PRODUCTS

The products offered are those listed on the https://www.thcp.fr/gb/ website of Jerycan PT, while stocks last. Jerycan PT reserves the right to modify the range of products at any time.

Each product is presented on the site with a description of its main technical characteristics (capacity, use, composition, etc.). The photographs are as accurate as possible but are not binding on the Seller. The sale of the products presented on the https://www.thcp.fr/gb/ website is intended for all buyers residing in countries that fully authorise the entry of these products into their territory.

Article 3. PRICES

The prices indicated on the product sheets of the internet catalogue are prices in euros (€) inclusive of all taxes (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. Jerycan PT reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalogue on the day of the order will be the only price applicable to the buyer. The prices indicated do not include delivery costs, which will be invoiced in addition to the price of the products purchased, on the basis of the total amount of the order.

Article 4. ORDERING AND PAYMENT CONDITIONS

Before placing an order, the purchaser must create an account on the https://www.thcp.fr/gb/. website. The account creation section can be accessed directly from the side menu bar. At each visit, if the buyer wishes to place an order or consult his/her account (order status, profile, etc.), he/she must identify him/herself using his/her contact information. Jerycan PT offers the buyer the possibility of ordering and paying for products in several stages, with 3 payment options to choose from:

Payment by bank transfer: The buyer selects the products they wish to order in the "basket", modifies them if necessary (quantities, references, etc.), checks the delivery address or provides a new one. Next, the shipping costs are calculated and submitted to the buyer, along with the name of the carrier. The buyer then chooses their preferred method of payment: "Payment by bank transfer". In the final stage, the buyer is asked to read all the information, acknowledge and accept these general terms and conditions of sale by ticking the appropriate box, and then confirm the order by clicking on the "Confirm my order" button. This last click constitutes the final conclusion of the contract. As soon as the order has been confirmed, the buyer will receive an order confirmation, confirming that the order has been registered. To finalise payment and start processing the order, the buyer must contact his or her bank to make the transfer corresponding to the amount of the order to Jerycan PT's bank account, the details of which are provided to the buyer. Upon receipt of the transfer, the order will be processed and the buyer will be informed by email. Jerycan PT will ship the products at the earliest 2 business days after receipt of the transfer corresponding to the order, subject to availability.

Secure payment by credit card: The buyer selects the products he/she wishes to order in the "shopping basket", modifies them if necessary (quantities, references, etc.), verifies the delivery address or provides a new one. Next, the shipping costs are calculated and submitted to the buyer, along with the name of the carrier.

Next, the buyer chooses their preferred method of payment: "Payment by credit card". The next step asks the buyer to check all the information, to read and accept these general terms and conditions of sale by ticking the appropriate box, and then invites them to confirm their order by clicking on the "Confirm my order" button. If payment is accepted, the order is recorded and the contract is definitively formed. Payment by credit card is final. In the event of fraudulent use of the card, the purchaser may request cancellation of the card payment, and the sums paid will be credited or refunded. The cardholder will not be held liable if it is proven that the disputed payment was made fraudulently, at a distance, without physical use of the card.

Confirmation of the order implies acceptance of these terms and conditions of sale, acknowledgement of full knowledge thereof and waiver of any other terms and conditions of purchase. Jerycan PT will ship products at the earliest 2 business days after receipt of payment by credit card corresponding to the order. All data provided and the order confirmation constitute proof of the transaction. If the buyer has an e-mail address and has indicated it on the order form, Jerycan PT will send an e-mail confirming that the order has been registered.

Article 5. RETENTION OF OWNERSHIP

Jerycan PT retains full ownership of the products sold until full payment has been received, in principal, fees and taxes included.

Article 6. RIGHT OF RETURN

The buyer has a period of fourteen working days from delivery of the order to exercise the right of withdrawal and return the product to the seller for exchange or reimbursement without penalty, with the exception of return shipping costs.

Article 7. DELIVERY

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Orders are carried out by GLS, a delivery service with tracking and delivery without signature. Delivery times are given as an indication only; if they exceed thirty days from the date of the order, the sales contract may be cancelled and the buyer will be reimbursed. Jerycan PT may inform the buyer of the tracking number of the parcel by e-mail. The buyer is delivered to his/her home by his/her postman. If the buyer is absent, the postman will leave a calling card, allowing the buyer to pick up the products ordered at the nearest post office within a period indicated by the postal services. The risks associated with transport are the responsibility of the buyer from the moment the products leave the premises of Jerycan PT. The buyer is responsible for verifying the condition of the packaging and the contents of the goods upon delivery in the presence of the GLS representative or the delivery person.
